The project lies within the Scenic Park Overlay District, which is for areas next to Guajome County Park, but it does not comply with the zoning requirements. Per Article 22 of the City of Oceanside's Zoning Ordinance posted below, one of the purposes of this zoning designation is to
"conserve and protect valuable natural resources of recreational and scenic areas in and adjacent to the Guajome Regional Park and other public parks." This project will destroy, not conserve.
Furthermore, Section 4.1-6 of the dEIR makes the following false statement: “due to the project’s location surrounded by residential developments, the lack of scenic viewpoints or scenic vistas in the immediate area, and the developed nature of the vicinity, development of the project site is expected to blend with the surrounding uses.” This area has quite the opposite of a “developed nature” as it is next to a large natural regional park. This high-density project certainly would not "blend in," as the surrounding houses are multi-acre equestrian homes!
It makes no sense to give it a Scenic Park zoning designation but also claim it lacks scenic value.
